The City of Martinez Public Safety Subcommittee has been considering a draft ordinance to repeal and replace the City’s existing ordinance regarding the establishment of medical cannabis dispensaries. The existing Ordinance No. 1277 C.S. was adopted in July 2000 and requires, among other things, that dispensaries apply for and receive a Conditional Use Permit, subject to the approval of the Planning Commission or City Council. The draft ordinance permits the establishment of medical cannabis dispensaries by Dispensary License at the discretion of the City Manager.
A copy of a preliminary draft ordinance was circulated at the March 8, 2010 Public Safety Subcommittee meeting, and the City received comments on the through April 8, 2010. Public Safety Subcommittee meetings were held on April 26th, May 18th, July 6th, July 12th, and August 9th to make revisions to the draft ordinance. A special meeting was called on January 7, 2011, to review the revisions and make additional recommendations.
